1) BOOKING FEE AND PAYMENT:

By booking with Precious Memories Photography the Client enters into a contract and therefore agrees to abide by the terms and conditions.

A retainer fee of £50 is required for all portrait sessions & £30 for mini sessions.

This is a non-refundable deposit except in the event Precious Memories Photography cancels the booking. In the event of client cancellation, the deposit paid is non-refundable. It shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. No date is reserved until a deposit is received. The deposit shall be applied towards the total cost of the service to be rendered.

The balance of the complete package price must be paid before or on the day of event. Precious Memories Photography reserves the right to not proceed with the session or to withhold images if payment in full, cleared funds is not made. Additional custom orders (reprints, enlargements, albums) must be paid in full at the time of order.

2) HEALTH AND SAFETY:

The Client is responsible for the children's safety during the photography session. The Client must therefore ensure that a responsible adult, other than the Photographer, is present at all times to supervise the children.

In the case of a Cake Smash/1st birthday session for which the Photographer is supplying the cake it is the responsibility of the Client to make Precious Memories Photography aware, at least 14 days prior to the photography session of any relevant allergies that the child may have. In this event the Photographer will not supply the cake and instead the Client is responsible for supplying the cake and will deduct £30 off the session cost.

3) CANCELATION:

The Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the monies paid to book are non-refundable but are transferable if a date change is necessary as long as 24 hours notice is given. If it is not possible for a session to take place on a scheduled day due to weather, or at the fault of the Photographer, the Photographer and the Client will reschedule on an agreed date at the earliest convenience with no additional charge.

4) SESSION IMAGES: 

Images will be put onto an online gallery once they are finished where the client can download as they wish using a pin code provided for a maximum of approx 6 months. If a USB or prints are included in the session price, then they will be posted out approx 3 weeks after the images are put onto the gallery. Photographs will be stored on a back up hard drive for as long as the photographer can keep them.

5) COOPERATION:

Please only bring the people that will be photographed to the session.

Photographer’s camera is the only camera allowed at the photo session because of the distraction it causes, especially to small children, which hinders the Photographer’s ability to obtain quality shots, unless otherwise agreed with the Photographer.

6) DIGITAL IMAGES PRINTS & COPYRIGHT: 

1) All images and copyrights are the property of Precious Memories Photography. In exchange for services provided, the Photographer retains the exclusive right to edit and use for any reason, including but not limited to: Facebook advertising, website marketing, competitions and monetary gain.

2) All photos created by Photographer are copyright protected. It is a violation of copyright law to copy, scan, or allow photographs to be reprinted, duplicated, digitally reproduced, copied, scanned, used commercially or altered digitally or otherwise, without the Photographer's express written permission.

3) The client may print (on their own) their personal photographs. Unauthorised use can effect my livelihood and reputation and may also harm my ability to produce high-quality artwork in the future. All contents remain copyright of Precious Memories Photography.

4) In the event of unauthorised reproduction, the Client shall pay by way of liquidated damages to Precious Memories Photography an unauthorised use fee of £1000 per image, or double the standard reproduction fee for the use concerned, whichever is the greater.

5) The right to reproduce an image granted by Precious Memories Photography is personal to the Client and may not be assigned to any third party without Precious Memories Photography prior written consent.

7) USE OF IMAGES:

This license allows the client to do the following with the images:

Display the images; Print the images;

Upload, email, or electronically transfer the images or files; and,

Publish the images on personal websites or social media websites

8) THIS LICENSE WILL PROHIBIT THE CLIENT FROM DOING THE FOLLOWING:

APPLYING FOR COPYRIGHT OR SELLING OF ANY IMAGE OR ELECTRONIC FILES SUPPLIED BY PHOTOGRAPHER

MAKING ‘DERIVATIVE WORKS’ OR OTHERWISE MODIFY, INCLUDING EDITING AND/OR MANIPULATING ELECTRONIC FILES

9) EXHIBITION: 

Client grants Photographer permission to display selected images resulting from this assignment as an example of Photographer’s work.

10) LIMIT OF LIABILITY: 

In the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond the Photographer’s control, the Photographer’s liability is limited to the refund of all payments received, or a reshoot that can be scheduled at no additional cost. In the unlikely event that the Photographer is injured or becomes too ill to attend the portrait session, the Photographer will make every effort to reschedule to the earliest possible date.

11) MODEL RELEASE: 

For valuable consideration received, the client grants Precious Memories Photography full permission concerning any images that she has taken or may take to use, publish, and republish the photographs and grants the Photographer the right to use the images for advertising including any form of social media, competition, print or website unless discussed otherwise during the session.

The creation of your images involves experience, vision, skill, effort and artistry to the highest possible level.

Under no circumstances should any of these images be used commercially without Precious Memories written consent.

The photographs are NOT ALLOWED to be edited in ANY way, shape or form (this includes social media filters or turning into black and white).

The undersigned have read and understood the contract and agree to the terms and conditions.

12) CAMERA POLICY:

Cameras, camera phones, camcorders or any other recording equipment is NOT permitted during any session, either in the studio or on location, without the express permission of My Magical Memories Photography.
